Terms of Service

Please read these terms carefully before using Clause.

1. Agreement to Terms

By accessing or using Clause ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Not a Law Firm

Clause is a legal technology platform, not a law firm. We do not provide legal advice. The documents generated by Clause are based on publicly available legal information and are intended to serve as a starting point for your prenuptial agreement. We strongly recommend that both parties consult independent legal counsel before signing any prenuptial agreement.

3. Use of the Service

You must be at least 18 years of age to use the Service. You agree to provide accurate, complete information during registration and throughout the Agreement Builder. You are responsible for maintaining the confidentiality of your account credentials.

4. Payments and Refunds

Access to full document generation requires a one-time payment. Payments are processed securely through Stripe. If you are not satisfied with your purchase, contact us within 30 days of payment for a full refund. Refunds are issued at our discretion.

5. Document Accuracy and Enforceability

While we strive to provide accurate, state-specific prenuptial agreements, Clause does not warrant that any document generated through the Service will be enforceable in your jurisdiction. Enforceability depends on many factors including how the agreement is executed, the laws of your state, and the circumstances of your relationship. Attorney review is strongly encouraged.

6. Intellectual Property

All content, design, software, and functionality of the Service are the exclusive property of Clause and are protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without express written permission.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Limitation of Liability

To the fullest extent permitted by law, Clause shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability for any claim shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the updated Terms.
